Birth Injury
If something goes wrong during the latter stages of pregnancy or during a birth, the consequences can be very severe for both mother and baby. Lester Morrill’s team has many years’ experience of acting for people in birth injury claims. One of our solicitors was formerly a midwife. We have developed considerable expertise in applying the law to the medical evidence in this field and our solicitors have handled many of these claims successfully over the years.
Injuries to the baby can include:-
- asphyxia in the latter stages of labour leading to neurological illness immediately after birth, admission to the special care baby unit and possibly cerebral palsy;
- Erb’s palsy;
- brachial plexus injury;
- fractured limbs;
- problems with vision.
Injuries to the mother can include:-
- urological injury;
- perineal tears;
- infection.
Time limits - Birth Injury
Where the mother is injured, the normal time limit rules apply and any claim for damages must be commenced by the issue of court proceedings within 3 years of the birth. Where the child is injured, however, time will not start to run in any case until the child reaches the age of 18 years. If the child is severely injured and unable to manage his or her own affairs, time may not run at all.
