Where the mother is injured, the normal time limit rules apply and any claim for damages must be commenced by the issue of court proceedings within 3 years of the birth. Where the child is injured, however, time will not start to run in any case until the child reaches the age of 18 years. If the child is severely injured and unable to manage his or her own affairs, time may not run at all.
