Care Proceedings and Child Protection
Care proceedings are designed to protect children deemed by Social Services to be at risk of harm – they have a duty to investigate any report of such a risk and may begin these proceedings if they feel it is appropriate.
As a parent or carer facing allegations of child neglect or abuse, it is important to obtain legal advice urgently to establish their legal position. Early decisions, action and taking on board advice can have a significant impact on both the proceedings and the final outcome as to what is to happen to the children.
Courts have a duty to work towards reuniting a child with its family provided any concerns as to the child’s welfare are satisfactorily addressed.
As advisors to parents we will represent you at court hearings and provide you with support and guidance through this complex and daunting process. Public Funding (legal aid) is available free to all parents, regardless of income, when court proceedings are started. It may also be available to people who were careering for a child before the proceedings started.
