All married parents automatically have parental responsibility for their children. Unmarried fathers will not unless their child was born after December 2003 and they have signed the register of births as the father. All other fathers have to either apply for a Parental Responsibility Order from the court or, with the consent of the child’s mother, they can enter into a Parental Responsibility Agreement which is registered with the Principal Registry in London.
In the vast majority of cases parents are able on separation or divorce to reach an amicable arrangement regarding their children. However, if there is a dispute as to where the children are to live, this can be resolved with the help of our legal team or through mediation or on application to the court.
Many disputes regarding the arrangements for contact are as a result of difficulties in communication and mistrust between the parents and grandparents. Our team aims to minimise these disputes, help the parties to build a better understanding of the other parent’s views and if this is not possible then to guide and support the client and the child through the court process.
We are able to advise prospective adoptive parents on this difficult process and give guidance as to alternatives to adoption such as joint residence or special guardianship.
