Legal Aid (Representation Order) is available for the vast majority of cases before the Crown Court and we will assist you in obtaining that order.
Recent changes to the availability in public funding have meant that 20% of all people facing prosecution are no longer eligible for Criminal Legal Aid. Our first duty to all our clients is to advise on their eligibility to legal aid and if you do pass the various tests we will assist you in applying. However each stage of the criminal proceedings has different criteria for Legal Aid:
If you are interviewed by the police in respect of a criminal offence, no matter what level of income you have, advice is publicly funded. Therefore all advice whilst at the police station is free.
If you are to appear before the Magistrates’ Court then depending upon the seriousness of the offence and your level of income (currently this means less than £20,739 per year) you may be eligible for Criminal Legal Aid. We have a duty to advise you on eligibility and funding will be resolved before you incur any expenses to us.
Funding for advice relating to the most serious cases which go before the Crown Court are not currently affected by the level of the client’s income. Therefore invariably people are entitled to Criminal Legal Aid.
