Financial Settlements

When separating, one of the most important steps toward finalising matters and moving on with life is settling the financial position.

Financial proceedings, whilst an important feature of any relationship breakdown, are technically separate from proceedings relating to the divorce or dissolution of the civil partnership.  The financial claims that the married person can pursue on the breakdown of a marriage are referred to as ‘ancillary relief’. This covers what to do with the family home, claiming maintenance for yourself and/or the children the division of pensions, savings and other investments. We are also able to assist you in assessing potential entitlement to welfare benefits and debt management.

Elizabeth Bowskill is a qualified mediator and collaborative lawyer. These are alternatives ways to resolve your family disputes . Please see our page on Alternative Dispute Resolution for further details as to these processes.

Even if you do not want to start formal proceedings for divorce or civil partnership dissolution, you will benefit from receiving legal advice. In our experience if you decide not to seek advice as you separate, it can be more expensive both emotionally and financially in the long term.
