Mediation

Mediation is a route by which couples can arrive together at fair, enduring arrangements, thus reducing the confrontational element which may be present in separation or divorce negotiations.

Mediators do not give legal advice and do not represent individuals, although mediators can be solicitors or other professionals who deal with families.  An impartial mediator (or pair of mediators) is nominated jointly by the couple to provide a safe forum in which to air their differences and constructively arrive at financial settlements and arrangements for children.  These agreements are achieved as a couple, rather than having judges make the decisions for them. 

The mediator(s) summarise the proposals agreed by the couple.  Each of the couple take it to their own solicitor who will advise them whether to turn it into a legally binding agreement (as well as taking care of any other legal matters such as the actual divorce).

If you are eligible for public funding then you may be entitled to free mediation, along with free "Help with Mediation" from a solicitor.
