Paying For Your Case

Generally speaking, if you win your case your opponent will pay your legal costs.  If your case is unsuccessful you will want protection against having to pay your opponent’s costs.

As part of our initial assessment of your case we will discuss the funding options available to you.  We will make sure that you understand what costs, if any, you might have to pay yourself.  One of our specialist solicitors will advise you so that you can choose the best funding option for you.  A brief summary of the options is as follows:-

  1. Public funding (formerly known as Legal Aid).  We are franchised by the Legal Services Commission in clinical negligence.  This means that we meet their quality standards.  We can offer you this option if you are financially eligible and do not have other methods of funding available.  We can advise whether you will be eligible.

    If the Legal Services Commission is prepared to support your case, it will issue a certificate of public funding, which will stipulate a budget and the extent of the work which the solicitor may do on your behalf.  Your public funding certificate will cover you if you lose the case.
  1. Legal expenses insurance.  Many people have legal expenses insurance available as part of their home contents, motor or travel insurance.  Some banks and credit card companies also provide legal expenses insurance for their customers.  If you have this type of cover, you should contact your insurers to obtain a claim form.  Some insurers require that claims for legal expenses cover are made within a very short timescale.
  1. Conditional fee agreement. We can offer you a conditional fee agreement (commonly known as ‘no win on fee’) in certain circumstances.  If you have no other form of funding available, we may ask you to pay for some initial investigation work so that we can properly assess the prospects of success.  We may then be able to enter a conditional fee agreement with you. We can advise on obtaining insurance to protect you from liability for your opponent’s legal costs.
